Supreme Court to Evaluate the Future of TPS for Thousands of Syrians and Haitians

Instead of allowing the immediate elimination of the program, the judges opted to analyze the case in depth and expeditiously.

On Monday, the U.S. Supreme Court decided to temporarily block the Trump administration’s plans to deport approximately 6,000 Syrians and more than 350,000 Haitians holding Temporary Protected Status (TPS), while simultaneously expediting the judicial process to resolve the case in the coming months.

The high court scheduled hearings for April, with a decision expected before the end of June, in what could become a pivotal ruling regarding the scope of the government’s immigration policies.

TPS is a legal mechanism that allows individuals from countries affected by armed conflict, natural disasters, or other extraordinary crises to live and work temporarily in the United States. However, the Trump administration seeks to terminate this status for migrants from more than a dozen countries as part of a more restrictive immigration policy.

In two emergency appeals, the government asked the Supreme Court to lift lower-court rulings that had kept protections for Haitians and Syrians in place while their lawsuits were being resolved. Nevertheless, rather than allowing the immediate termination of the program, the justices opted to examine the case in depth and on an expedited basis.

Among the key issues the Court must resolve are whether decisions regarding TPS are subject to judicial review, whether beneficiaries have legal grounds to challenge them, and whether principles of equal protection under the law have been violated.

The TPS program has served as a pathway to protection for hundreds of thousands of people: Haitians obtained the status following the devastating 2010 earthquake, while Syrians have qualified since 2012 due to the civil war in their country.

Although the current decision temporarily maintains these protections, the Court’s final ruling could determine the future of more than one million migrants and set a precedent regarding the government’s power to revoke such benefits without judicial oversight.
